These terms are an agreement between you and Kiln AI of New York, United States, which runs Kiln. By creating an account or using Kiln you agree to them. If you do not agree, do not use Kiln.

They are written to be read. Where they use "Kiln" they mean the product and the company that runs it; where they say "you" they mean the person using it, or the parent or guardian who has given a minor permission to.

1. Who can use Kiln

You must be at least 13 years old to use Kiln. If you are under 18, you may use it only with the permission of a parent or guardian, who agrees to these terms on your behalf and is responsible for your use. Kiln may close an account it has reason to believe belongs to someone under 13.

2. Your account

  • Sign up with an email address you control and keep it current, because it is how Kiln reaches you and how you prove the account is yours.
  • Keep your password to yourself. Everything done with your account is your responsibility until you tell Kiln it has been compromised.
  • One account is for one person. Do not share it or let someone else use it.

3. What Kiln does, and what it does not

Kiln keeps the class material you give it and uses AI models to turn that material into practice questions, flashcards and summaries, to transcribe recordings, to answer questions about it, and to track your progress. The questions, answers, summaries and explanations it produces are generated by software. They may be inaccurate, incomplete, out of date, biased or misleading, Kiln does not check them against your course, and you should not rely on them without confirming them against your own material.

Kiln is a study aid. It is not a teacher, a tutor in the human sense, or a source of academic, legal, medical or other professional advice, and nothing it produces should be relied on as such. You are responsible for following your school's rules on academic integrity in how you use it.

4. Acceptable use

Using Kiln, you agree not to:

  • Upload material you do not have the right to use, including textbooks, papers or recordings whose copyright holder has not permitted it, or other people's personal information without their consent.
  • Upload anything unlawful, or use Kiln to produce anything unlawful, harmful or harassing.
  • Interfere with the service: probe or attack it, scrape it, overload it, reverse-engineer it, or work around the limits of your plan.
  • Use Kiln to build a competing product, or to train models on what it produces.
  • Resell access to Kiln or share your account.

Kiln may remove material or suspend an account that breaks these rules, with notice where that is practical.

5. Your content and what Kiln makes from it

You own all right, title and interest in your notes, attachments, recordings and everything else you put into Kiln. So that Kiln can run the service for you, you grant Kiln a worldwide, non-exclusive, royalty-free licence, with the right to sublicense to the providers it uses, to host, store, reproduce, process, transmit and display that content, and to modify it only as needed to format it, solely in connection with operating and providing the service. That licence ends when the content is deleted. Kiln does not use your content to train models and claims no other rights in it.

You may use what Kiln generates from your content however you like, and Kiln claims no ownership of it. Because generated text is not unique, similar or identical output may be produced for other people, and Kiln cannot promise it is original or free of others' rights.

You are responsible for having the right to upload what you upload. If a copyright holder tells Kiln that material infringes their rights, Kiln may remove it and will tell you.

6. Plans, billing and cancellation

Kiln has a Free plan and two paid plans, Plus and Unlimited. Each plan's price and its allowances, such as how many pages you can add in a month and how many tutor turns you can take in a day, are the ones shown on Kiln's pricing page when you choose it, and Kiln enforces them as shown.

  • Paid plans are subscriptions billed in advance, monthly or yearly, through Stripe, which handles your card. They renew automatically at the end of each period until you cancel.
  • You can cancel at any time from your account's billing page, which opens Stripe's customer portal. Cancelling stops the next renewal; you keep the paid plan until the period you have paid for ends, and then move to the Free plan.
  • If a price changes, Kiln will email you at least 30 days before it applies to your subscription, and you can cancel before then.
  • If a payment fails, Kiln will tell you and may move your account to the Free plan until it is settled.
  • Prices are in US dollars and do not include taxes, which are added where the law requires.

7. Refunds

If you subscribe to a paid plan for the first time and change your mind, write to the contact address at the top of this page within 14 days of that first payment and Kiln will refund it in full, to the card you paid with. Beyond that, payments are non-refundable and there are no credits for partially used subscription periods: cancelling keeps your plan until the end of the period you have paid for rather than returning money for the rest of it. Where the law where you live gives you more than this, that law applies.

8. Kiln's property

Kiln, its name, its design and its software belong to Kiln AI and its licensors. These terms give you the right to use the service as it is offered, and nothing more; they do not give you any right to copy, change or redistribute it.

9. Ending the agreement

You may stop using Kiln at any time, and can ask for your account and everything in it to be deleted by writing to the contact address; the privacy policy says how that works and how long it takes. Kiln may suspend or close your account if you break these terms, if the law requires it, or if Kiln stops offering the service, and will give you notice and a chance to export your material where that is practical.

10. Disclaimers

Kiln is provided "as is" and "as available", without representations or warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement, to the extent the law allows. Kiln AI does not promise that the service will be uninterrupted, error-free or secure, that generated material will be accurate or suitable for your purpose, or that using it will produce any particular grade or result. Keep your own copies of material you cannot afford to lose.

11. Limits on liability

To the extent the law allows, Kiln AI is not liable for indirect, incidental, special or consequential losses, including lost data, lost marks or lost opportunities, arising from your use of Kiln or from anything it generates. Kiln AI's total liability for all claims relating to Kiln is limited to the greater of the amount you paid for it in the twelve months before the claim or one hundred US dollars. Some places do not allow some of these limits, and where that is so they apply only as far as the law permits.

12. Changes to these terms

When these terms change, the new version is published on this page with a new effective date. If a change materially affects your rights, Kiln will email the address on your account at least 30 days before it takes effect. Using Kiln after that date means you accept the new terms; if you do not, stop using Kiln and ask for your account to be deleted.

13. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute about Kiln or these terms is heard by the state or federal courts located in New York, and you and Kiln AI each agree to their jurisdiction, except that either may bring a claim in the small claims court where you live. If you are a consumer in a place whose law gives you the right to sue at home, these terms do not take that right away.

If part of these terms cannot be enforced, the rest still applies. These terms and the privacy policy are the whole agreement between you and Kiln AI about Kiln.
